While the employer is deciding, it has to pay for up to $10,000 of medical treatment (5402). The one-year filing limit runs from the injury date, or from the last disability payment or medical treatment the employer provided, so it can restart. What a workers' comp lawyer costs

Nothing up front. The state's guidebook for injured workers says the fee is usually 9 to 15 percent of your final permanent disability settlement or award, and a workers' comp judge has to approve it. The fee comes out of the award, so you don't write a check.

Having a lawyer also changes the medical exam process. Without one, you pick a doctor from a random panel of three Qualified Medical Evaluators the state sends you, and you have 10 days to choose. With one, your lawyer and the insurer can agree on an evaluator together (an AME), an option that's only open to represented workers.

Temporary disability pay in 2026

If you can't work while you recover, temporary disability pays two-thirds of your average weekly wage, within state limits. For injuries in 2026 the minimum is $264.61 a week and the maximum is $1,764.11 a week, up 4.9% from 2025.
